Elevated Resources LLC ("we," "us," or "our") owns and operates elevatedresources.net and other sites linking to these Terms of Use (individually, the "Site," and collectively, the "Sites"). Through the Sites, Elevated Resources LLC provides various offerings, information, and resources related to the products and services available on our Sites (each a "Service" and collectively, the "Services").

Elevated Resources LLC may change, suspend, modify, or discontinue all or any part of the Sites in its sole discretion with or without notice. Elevated Resources LLC reserves the right to block or deny access to any of the Sites to anyone at any time for any reason.

Elevated Resources LLC provides business services across three primary divisions: Commerce & Wholesale, AI & Automation Solutions, and Government Solutions. Our Sites serve as informational and inquiry platforms for prospective clients, partners, and government agencies seeking to engage our services.

We reserve the right to modify, suspend, or discontinue any service at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.

The Elevated Resources LLC name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Elevated Resources LLC or its affiliates. You must not use such marks without the prior written permission of Elevated Resources LLC.

If you submit any content to the Sites (including through contact forms or inquiry submissions), you represent and warrant that you own or control all rights in and to such content, and that such content does not violate these Terms of Use.

By submitting content, you grant Elevated Resources LLC a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, and display such content for the purpose of providing and improving our services.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ELEVATED RESOURCES LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

You agree to defend, indemnify, and hold harmless Elevated Resources LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Use or your use of the Sites.

THE SITES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ELEVATED RESOURCES LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ELEVATED RESOURCES LLC DOES NOT WARRANT THAT THE SITES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Elevated Resources LLC reserves the right to update or modify these Terms of Use at any time, with or without prior notice. Any such changes will become effective upon the earlier of (i) the first time you use the Sites with actual notice of the change(s), or (ii) 30 days after the change(s) are publicly posted on the Sites.

We encourage you to review these Terms of Use frequently to stay informed of any changes. Your continued use of the Sites following the posting of revised Terms of Use means that you accept and agree to the changes.

Any dispute arising out of or relating to these Terms of Use or the Sites shall first be addressed through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, the parties agree to submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association.

Arbitration shall take place in Oakland, California. The arbitrator's decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights.

These Terms of Use and any dispute or claim arising therefrom or related thereto shall be governed by and construed in accordance with the internal laws of the State of California, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Sites shall be instituted exclusively in the federal courts of the United States or the courts of the State of California, in each case located in the County of Alameda.
